S (1980 Hague Convention) – Firm confirmation from the High Court that evidential privilege attaching to Family Mediation is absolutely sacrosanct in relation to all proceedings, including proceedings relating to children.    Whilst the Court discourages negotiating on a “without prejudice” basis in relation to arrangements for children, this judgment confirms that it is possible to negotiate on this basis and the Court will not waiver without prejudice discussions to try and reach a voluntary compromise.
