Early Neutral Evaluation (“ENE”)

If you and your former partner have an amicable relationship, are prepared to deal with matters directly on a face to face basis but need guidance and assistance with the issues that need to be resolved, ENE may be a helpful ADR option.

When we act as an Early Neutral Evaluator, our role is to assist both parties in reaching their own resolution, with the assistance of separate legal representation if required.    We will be completely independent and impartial in the view we provide to a separated or separating couple.

We will assist both parties to collate any information required to resolve the dispute, we will help identify the issues which need to be resolved and we will provide our assessment of each of the issues to be determined.

Like mediation, ENE is a voluntary process and, unless the parties agree to the contrary, they will not be bound by the recommendations provided by the evaluator.   The purpose of ENE is to provide both parties with an independent and impartial assessment of the relevant issues and recommendations for settlement at an early stage, saving time and cost to narrow issues in dispute and reach a voluntary resolution.
