Divorce law was reformed in England & Wales in April 2022 to make the procedure simpler and less acrimonious. It is now possible for either party to a marriage to present a divorce petition at any time, provided that the marriage has lasted for over one year.
The only basis for a divorce is now that the marriage has “irretrievably broken down”, you do not need to give any reasons to justify why the marriage has come to an end. You are also able to present a petition for divorce jointly with the other party, but you can also present a divorce petition on the basis of a sole application (so you will not be prevented from proceeding if you think the other party may not co-operate).
The new procedure makes it easier to complete divorce proceedings yourself using the government online divorce portal. However, it is essential to seek legal advice so that you properly understand how to resolve any associated issues connected to the divorce such as the financial aspect of the marriage breakdown and any issues relating to the future arrangements for your children.
